It is imperative that you review the attached Notice of Proposed Rule and determine its impacts upon your compost production and marketing. The FLCC and its members need to be fully involved in the upcoming June 19th Notice of Rule Development Workshop, and prepared to voice our support and/or opposition to the various changes to Rule 5E-1002.
I am recommending that we convene a Zoom meeting for early next week for all interested parties to discuss their review of the Notice of Proposed Rule, and determine the appropriate response from Florida’s composting industry. I will be prepared to accept and provide an industry response on FLCC letterhead, and the appropriate FLCC members to present our position at the June 19th Rule Development Workshop.
My experience to date on the State of Florida’s Fertilizer rule has been limited since it has been an accepted Florida composting industry position that compost is not fertilizer, and therefore not subject to the fertilizer registration and tax, and the Department of Agriculture and Consumer Services has been very selective and inconsistent with how they have treated compost and its producers.
If this Proposed Rule will change that position, then we need to be fully engaged with the Rule Workshop process to comprehensively state our concerns and request that they be addressed.
I believe with our collective effort that we can make a difference.
